Introduction and Overview

Yesterday, the new ADA Title II rule focused on website/app accessibility for state and local governments was published in the Federal Register. This means the rule is now official and will be effective on June 24, 2024.

As shared earlier, this means that all services created, procured, or managed by a PSU will need to meet WCAG 2.1-AA accessibility standards within two or three years, depending on the size of the municipality served. Please see the table below for a list of LEAs and the compliance requirement date. Charter schools - please review the municipalities in your service area - your compliance date is the earliest date required by the municipalities you serve.

In the coming weeks, DPI will be putting out implementation guidance, procurement resources, and training to help PSUs comply with this new rule. We will also be sharing additional information in the Thursday DTL leader meetings.

Recommendations for Immediate Steps

1. Begin to identify "content producers" in your districts. We know your teachers and communications staff are producing web-based and digital content, but who else may also be (PTAs, students, volunteers, etc.)? All materials created by these individuals on behalf of your PSU will be subject to this rule. This will include materials created internally as well as content that is procured.
2. Begin to request a Voluntary Product Accessibility Template (VPAT) from your vendors (instructions for vendors). This will help you identify areas of gaps that vendors will need to rectify prior to the compliance date. While DPI is working on sample language for your contracts, consider adding to contracts that WCAG 2.1-AA compliance will be required by your compliance date.
3. Begin to make a plan for training staff. Training materials will be shared and resources will be made available to help you with these training sessions.
